Terms of Use

These Terms of Use (“Terms”) are between you and Friday Technologies Pty Ltd (ABN 94 527 711 494) (“Friday Technologies”, “we”, “us” or “our”). They apply to this website, our apps and any online service we provide that links to them (together, our “Services”).

By using our Services, you agree to these Terms. If you do not agree, please do not use them. Our apps are also subject to our End User Licence Agreement, and our handling of personal information is described in our Privacy Policy. If these Terms conflict with the EULA about an app, the EULA applies.

Client projects are governed by the written agreement we sign with each client, not by these Terms.

You agree to use our Services lawfully and not to:

• interfere with, disrupt or place an unreasonable load on our Services or their infrastructure;
• try to gain unauthorised access to any part of our Services, or to other users’ data;
• scrape, copy or harvest content or data from our Services by automated means without our permission;
• upload or send anything unlawful, harmful, misleading or that infringes someone else’s rights; or
• use our Services to send spam or other unsolicited messages.

If you are under 18, you should use our Services with the involvement of a parent or guardian, and some Services may have their own minimum age.

Where a Service lets you create an account, you are responsible for keeping your sign-in details secure and for activity on your account. Please give us accurate information and tell us promptly if you believe your account has been compromised. You can close your account at any time.

You keep ownership of any content you submit through our Services. You grant us a non-exclusive, worldwide, royalty-free licence to host, store and display that content only as needed to operate and provide the Services to you. You are responsible for making sure you have the right to submit it.

Our Services, including their software, design, text, graphics, logos and trade marks, are owned by or licensed to us and are protected by intellectual property laws. Friday Technologies is a registered trade mark of Friday Technologies Pty Ltd.

You may view and share content from this website for personal, non-commercial purposes. For our logos and brand assets, please follow our brand guidelines. Any other use needs our written permission.

Apps and in-app purchases bought through the Apple App Store or another app store are sold and billed by that store under its terms, and refunds are handled by that store. Nothing in these Terms limits your rights under the Australian Consumer Law.

Our Services may link to or rely on third-party websites and services, such as app stores, payment providers and mapping or analytics services. We are not responsible for their content or practices, and your use of them is subject to their own terms.

We are always improving our Services, and may change, suspend or discontinue any part of them at any time. We aim to give reasonable notice of changes that significantly affect you. Information on this website is provided for general purposes and may not always be complete or up to date.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded or limited.

Subject to the section above, our Services are provided “as is” and “as available”, and we do not promise they will be uninterrupted, error-free or free of harmful components.

To the extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss of data, profit, revenue or goodwill, arising out of or in connection with our Services. Where our liability cannot be excluded but can be limited, it is limited to resupplying the relevant Services or paying the cost of having them resupplied.

To the extent permitted by law, you agree to indemnify us against any claim, loss or cost (including reasonable legal costs) arising from your breach of these Terms or your misuse of our Services, except to the extent caused by our own negligence or breach.

We may suspend or end your access to our Services if you seriously or repeatedly breach these Terms, or if we need to for legal or security reasons. You can stop using our Services at any time.

We may update these Terms from time to time. The updated version will be posted on this page with a new “last updated” date. If you keep using our Services after a change takes effect, you accept the updated Terms.

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. If you are a consumer living elsewhere, this does not take away any protections you have under the laws of the place where you live.
